The International Peoples¡¯ Tribunal of Conscience in Support of the Vietnamese Victims of Agent Orange met on May 15 to 16 2009 in Paris to hear evidence of the impact of the use of Agent Orange by the US military in Vietnam from 1961 and 1971.¿¡ÀÌÀüÆ® ¿À·»ÁöÀÇ º£Æ®³² Èñ»ýÀÚµéÀ» Áö¿øÇÏ´Â ±¹Á¦ ¾ç½É ÀçÆǼҴ 1961³âºÎÅÍ 1971³â±îÁö º£Æ®³²¿¡¼ ¹Ì±ºÀÌ ¿¡ÀÌÀüÆ® ¿À·»Áö¸¦ »ç¿ëÇÏ´Â °ÍÀÌ ¿µÇâÀ» ¹ÌÄ£´Ù´Â Áõ°Å¸¦ µè±â À§ÇØ 2009³â 5¿ù 15ÀÏ¿¡¼ 16ÀÏ Æĸ®¿¡¼ ȸÀǸ¦ °¡Á³´Ù. The Tribunal received evidence and testimony from 27 people including victims and expert witnesses.±× ÀçÆǼҴ ÇÇÇØÀÚµé°ú Àü¹® ¸ñ°ÝÀÚµéÀ» Æ÷ÇÔÇÑ 27¸íÀ¸·ÎºÎÅÍ Áõ°Å¿Í Áõ¾ðÀ» ¹Þ¾Ò´Ù. The testimony from the victims was very compelling and the testimony of the experts tied the damages that these victims suffered to their exposure to Dioxin.ÇÇÇØÀÚµéÀÇ Áõ¾ðÀº ¸Å¿ì ¼³µæ·ÂÀÌ ÀÖ¾ú°í Àü¹®°¡µéÀÇ Áõ¾ðÀº ÇÇÇØÀÚµéÀÌ µð¿Á½Å¿¡ ³ëÃâµÇ¾úÀ» ¶§ ÀÔ¾ú´ø ÇÇÇØ¿Í ¿¬°üÀÌ ÀÖ¾ú´Ù. Testimony also described the extent of the spraying, the millions of persons exposed, the jungles and forests destroyed and families devastated.Áõ°Å´Â ¶ÇÇÑ ºÐ»çÀÇ ¹üÀ§, ³ëÃâµÈ ¼ö¹é¸¸¸íÀÇ »ç¶÷µé, Á¤±Û°ú ½£ÀÌ Æı«µÇ°í °¡Á·µéÀÌ Æı«µÈ °ÍÀ» ¹¦»çÇß´Ù.
After examining the evidence the Tribunal found that the United States Government and the Chemical manufacturers were aware of the fact that Dioxin, one of the most dangerous chemicals known to man, was present in one of the component parts of Agent Orange; yet they continued to use it and in fact suppressed a study which showed in 1965 that DioxinÁõ°Å¸¦ Á¶»çÇÑ ÈÄ, ÀçÆǼҴ ¹Ì±¹ Á¤ºÎ¿Í ÈÇÐ Á¦Á¶ ¾÷üµéÀÌ Àΰ£¿¡°Ô ¾Ë·ÁÁø °¡Àå À§ÇèÇÑ ÈÇÐ ¹°Áú Áß ÇϳªÀÎ µð¿Á½ÅÀÌ ¿¡ÀÌÀüÆ® ¿À·»ÁöÀÇ ¼ººÐ Áß Çϳª¿¡ Á¸ÀçÇÑ´Ù´Â »ç½ÇÀ» ¾Ë°í ÀÖ´Ù´Â °ÍÀ» ¹ß°ßÇß´Ù;±×·¯³ª ±×µéÀº ±×°ÍÀ» °è¼Ó »ç¿ëÇß°í 1965³â¿¡ ±× µð¿Á½ÅÀ» º¸¿© ÁØ ¿¬±¸¸¦ »ç½Ç»ó ¾ïÁ¦Çß´Ù. caused many birth defects in experimental animals.½ÇÇè µ¿¹°µé¿¡°Ô ¸¹Àº ¼±ÃµÀû °áÇÔÀ» ¾ß±â½ÃÄ×´Ù. It was not until the results of that study were released by a leak from concerned citizen that the use of Agent Orange was stopped.°ü·Ã ½Ã¹ÎµéÀÇ À¯Ãâ·Î ÀÎÇØ ¿¬±¸ °á°ú°¡ ¹ßÇ¥µÇ°í ³ª¼¾ß ¿¡ÀÌÀüÆ® ¿À·»ÁöÀÇ »ç¿ëÀÌ ÁߴܵǾú´Ù.
Considering that this Tribunal finds:º» ÀçÆǼҴ ´ÙÀ½ »çÇ×À» °í·ÁÇÑ´Ù.
1) that the evidence presented to the Tribunal has established that during the war of USA against Vietnam, from 1961 to 1971, military forces of the United States sprayed chemical products which contained large quantities of Dioxin in order to defoliate the trees for military objectives;1)ÀçÆǼҿ¡ Á¦ÃâµÈ Áõ°Å¿¡ µû¸£¸é 1961³âºÎÅÍ 1971³â±îÁö ¹Ì±¹ÀÇ º£Æ®³² ÀüÀï Áß¿¡ ±º»çÀû ¸ñÀûÀ» À§ÇØ ¸¹Àº ¾çÀÇ ´ÙÀÌ¿Á½ÅÀÌ ÇÔÀ¯µÈ ÈÇÐ Á¦Ç°À» ¹Ì±¹ ±º´ë°¡ »ìÆ÷ÇÏ¿´´Ù.
2) that the chemical products which were sprayed caused damages to the people, the land, the water, the forest, the ecology and the economy of Vietnam that this Tribunal can categorize as:2)º» ¹ýÁ¤ÀÌ ºÐ·ùÇÒ ¼ö ÀÖ´Â º£Æ®³²ÀÇ ±¹¹Î, ÅäÁö, ¹°, ½£, »ýÅÂ, °æÁ¦¿¡ ¿µÇâÀ» ÁØ ÈÇÐ Á¦Ç°Àº ´ÙÀ½°ú °°´Ù.
a. direct damages to the people:a. »ç¶÷µé¿¡°Ô Á÷Á¢ÀûÀÎ ÇÇÇØ: The illnesses produced directly to the people who have been exposed to Dioxin include cancer, skin disorders, liver damage, pulmonary and heart diseases, defects to reproductive capacity, as well as nervous disorders;´ÙÀÌ¿Á½Å¿¡ Á÷Á¢ ³ëÃâµÈ »ç¶÷¿¡°Ô ¹ß»ýÇÑ Áúº´¿¡´Â ¾Ï, ÇǺΠÁúȯ, °£ ¼Õ»ó, Æó ¹× ½ÉÀå Áúȯ, »ý½Ä ´É·ÂÀÇ °áÇÔ ¹× ½Å°æ Àå¾Ö°¡ Æ÷ÇԵȴÙ.
b. indirect damages to the children of those exposed to Dioxin, including severe physical deformities, mental and physical disabilities, diseases and shortened life spans;b. ´ÙÀÌ¿Á½Å¿¡ ³ëÃâµÈ ¾Æµ¿¿¡ ´ëÇÑ °£Á¢Àû ÇÇÇØ( ½É°¢ÇÑ ½Åü ±âÇü, Á¤½Å ¹× ½Åü Àå¾Ö, Áúº´ ¹× ¼ö¸í ´ÜÃà Æ÷ÇÔ)
c. damages caused to the land and forests, water supply, and communities.¶¥°ú ½£, ¹° °ø±Þ ¹× °øµ¿Ã¼¿¡ ¹ß»ýÇÑ ÇÇÇØ. The forests and jungles in large parts of southern Vietnam have been devastated and denuded, and may either never grow back or take 50 to 200 years to regenerate.º£Æ®³² ³²ºÎÀÇ ¸¹Àº Áö¿ªÀÇ ½£°ú Á¤±ÛÀº ȲÆóÈµÇ°í »ç¶óÁö°í, ´Ù½Ã´Â ´Ù½Ã ÀÚ¶óÁö ¾Ê°Å³ª 50~200³âÀÌ °É¸®Áö ¾ÊÀ» ¼öµµ ÀÖ´Ù. Animals which inhabited the forests and jungles have become extinct, disrupting the communities which depended on them.½£°ú Á¤±Û¿¡ ¼½ÄÇÏ´ø µ¿¹°µéÀº ¸êÁ¾µÇ¾ú°í, ±×µé¿¡°Ô ÀÇÁ¸ÇÏ´ø Áö¿ª »çȸ¸¦ Æı«Çß´Ù. The rivers and underground water in some areas have also been contaminated.ÀϺΠÁö¿ªÀÇ °°ú ÁöÇϼöµµ ¿À¿°µÇ¾ú´Ù. Dioxin will persist in the environment for many years; and´ÙÀÌ¿Á½ÅÀº ȯ°æ¿¡¼ ¼ö³â °£ Áö¼ÓµÉ °ÍÀÌ´Ù.
d. erosion and desertification necessarily will change the environment contributing to warming the planet and the dislocation of crop and animal life.d. ħ½Ä°ú »ç¸·È´Â ¹Ýµå½Ã Áö±¸ ¿Â³È¿Í ³óÀÛ¹°°ú µ¿¹°ÀÇ »îÀÇ È¥¶õ¿¡ ±â¿©Çϴ ȯ°æÀ» º¯È½Ãų °ÍÀÌ´Ù.
Considering also that this Tribunal finds:¶ÇÇÑ º» ÀçÆǼҴ ´ÙÀ½°ú °°ÀÌ ÆÇ´ÜÇÑ´Ù. 1) that the US war in Vietnam was an illegal war of aggression against a country seeking national liberation: the illegality is based on Articles 2(3) and 2(4) of the Charter of the United Nations which require countries to peacefully resolve their disputes.1)º£Æ®³²¿¡¼ÀÇ ¹Ì±¹ ÀüÀïÀº ±¹°¡Àû ÇعæÀ» Ãß±¸ÇÏ´Â ³ª¶ó¿¡ ´ëÇÑ ºÒ¹ýÀûÀΠħ·« ÀüÀïÀ̾ú´Ù. ºÒ¹ýÀº ±¹°¡µéÀÌ ºÐÀïÀ» ÆòÈÀûÀ¸·Î ÇØ°áÇϵµ·Ï ¿ä±¸ÇÏ´Â À¯¿£ ÇåÀå Á¦2Á¶(3)¿Í Á¦2Á¶(4)¿¡ ±Ù°ÅÇÑ´Ù. The massive spraying of Agent Orange/Dioxin on the southern part of Vietnam and the massive bombardment of the northern part of Vietnam clearly demonstrates that the United States violated the UN Charter mandate to refrain from the use of force in international relations;º£Æ®³² ³²ºÎ¿¡ ¿À¶û°Ô µð¿Á½Å ¿ä¿øÀÇ ´ë±Ô¸ð ºÐ»ç¿Í º£Æ®³² ºÏºÎ¿¡ ´ëÇÑ ´ë±Ô¸ð Æø°ÝÀº ¹Ì±¹ÀÌ ±¹Á¦ °ü°è¿¡¼ ¹«·Â »ç¿ëÀ» ÀÚÁ¦Ç϶ó´Â À¯¿£ ÇåÀå ¸í·ÉÀ» À§¹ÝÇßÀ½À» ºÐ¸íÈ÷ º¸¿© ÁØ´Ù.
2) that the Nuremberg Principles define a war of aggression as a crime against peace punishable under international law;2)´µ¸¥º£¸£Å© ¿øÄ¢Àº ħ·« ÀüÀïÀ» ±¹Á¦ ¹ý¿¡ µû¶ó ó¹ú ¹ÞÀ» ¼ö ÀÖ´Â ÆòÈ¿¡ ´ëÇÑ ¹üÁË·Î Á¤ÀÇÇÑ´Ù. 3) that the use of Dioxin was a war crime because it was a poisoned weapon outlawed both in customary international law and by the Hague Convention of 1907.3)´ÙÀÌ¿Á½Å »ç¿ëÀº °ü½ÀÀûÀÎ ±¹Á¦ ¹ý°ú 1907³â ÇìÀÌ±× Çù¾à¿¡ ÀÇÇØ ºÒ¹ýÈµÈ µ¶ÀÌ µç ¹«±âÀ̱⠶§¹®¿¡ ÀüÀï ¹üÁË¿´´Ù. [Hague Convention 23(a)].[ÇìÀÌ±× Çù¾à 23(a)] Violations of the customs and laws of war are considered war crimes under Principle VI b of the Nuremberg Principles.ÀüÀïÀÇ °ü½À°ú ¹ýÀ» À§¹ÝÇÏ´Â °ÍÀº ´µ¸¥º£¸£Å© ¿øÄ¢ Á¦6¿øÄ¢¿¡ µû¸¥ ÀüÀï ¹üÁË·Î °£ÁֵȴÙ. The Chemical companies knew how their Dioxin- laced products would be used in Vietnam; yet they continued to manufacture and supply these agents with very high levels of Dioxin to the US government.ÈÇРȸ»çµéÀº ±×µéÀÇ ´ÙÀÌ¿Á½ÅÀÌ Ã·°¡µÈ Á¦Ç°µéÀÌ º£Æ®³²¿¡¼ ¾î¶»°Ô »ç¿ëµÉ °ÍÀÎÁö¸¦ ¾Ë°í ÀÖ¾úÁö¸¸, ±×µéÀº °è¼ÓÇؼ ÀÌ ¹°ÁúµéÀ» Á¦Á¶ÇÏ°í ¹Ì±¹ Á¤ºÎ¿¡ ¸Å¿ì ³ôÀº ¼öÁØÀÇ ´ÙÀÌ¿Á½ÅÀ» °ø±ÞÇß½À´Ï´Ù. By providing poison weapons the companies were complicit in the war crimes committed by the US government;µ¶±Ø¹°À» Á¦°øÇÔÀ¸·Î½á ±× ȸ»çµéÀº ¹Ì±¹ Á¤ºÎ°¡ ÀúÁö¸¥ ÀüÀï ¹üÁË¿¡ ¿¬·çµÇ¾ú´Ù.
4) that the use of Dioxin was a crime against humanity as defined by VI c of the Nuremberg Principles, because it constituted an inhuman act done against a civilian population in connection with a crime against peace and war crimes;4)µð¿Á½Å »ç¿ëÀº ´µ¸¥º£¸£Å© ¿øÄ¢ VIc¿¡¼ Á¤ÀÇÇÑ ¹ÝÀηûÀû ¹üÁË·Î, ÆòÈ¿Í ÀüÀï ¹üÁË¿¡ ´ëÇÑ ¹üÁË¿Í °ü·ÃÇÏ¿© ¹Î°£Àο¡ ´ëÇØ ÀÚÇàµÈ ºñÀΰ£ÀûÀÎ ÇàÀ§À̱⠶§¹®ÀÌ´Ù.
5) that the use of illegal weapons in an illegal war has caused the devastation described above.5)ºÒ¹ýÀûÀÎ ÀüÀï¿¡¼ ºÒ¹ý ¹«±âÀÇ »ç¿ëÀº À§¿¡ ±â¼úµÈ Æı«¸¦ ¾ß±âÇß´Ù. These crimes have produced so much pain, suffering and anguish to at least 3 to 4 million people and their families.ÀÌ·¯ÇÑ ¹üÁ˵éÀº Àû¾îµµ 300¸¸¿¡¼ 400¸¸¸íÀÇ »ç¶÷µé°ú ±×µéÀÇ °¡Á·µé¿¡°Ô ¾öû³ °íÅë, °íÅë, °íÅëÀ» ÁÖ¾ú´Ù. The effects of these crimes will be felt for generations to come; andÀÌ·¯ÇÑ ¹üÁËÀÇ ¿µÇâÀº ¾ÕÀ¸·Î ¿©·¯¼¼´ë¿¡ °ÉÃÄ °¨ÁöµÉ °ÍÀÔ´Ï´Ù.
6) that the time has come to provide an adequate remedy to the Vietnamese victims of Agent Orange and their families and to repair as much as possible the environment of Vietnam.6)¿¡ÀÌÀüÆ® ¿À·»Áö(AgentOrange)ÀÇ º£Æ®³²ÀÎ ÇÇÇØÀÚ¿Í ±× °¡Á·µé¿¡°Ô ÀûÀýÇÑ Ä¡·á¹ýÀ» Á¦°øÇÏ°í º£Æ®³²ÀÇ È¯°æÀ» ÃÖ´ëÇÑ °³¼±ÇØ¾ß ÇÒ ¶§°¡ ¿Ô´Ù°í »ý°¢ÇÑ´Ù.
CONCLUSIONS:°á·Ð:
This Tribunal finds:ÀÌ ÀçÆǼҴ ´ÙÀ½ »çÇ×À» È®ÀÎÇÑ´Ù.
- that the United States Government is guilty of the offenses listed above and determines that the damage to the environment of Vietnam can be defined as ¡°ecocide¡±;¹Ì±¹ Á¤ºÎ°¡ À§¿¡ ¿°ÅµÈ ¹üÁË¿¡ ´ëÇØ À¯ÁËÀÌ¸ç º£Æ®³² ȯ°æ¿¡ ´ëÇÑ ÇÇÇظ¦ "¿¡Äâµµ¸£"·Î Á¤ÀÇÇÒ ¼ö ÀÖ´Ù°í ÆÇ´ÜÇÏ´Â °æ¿ì
- that the Chemical companies who were charged in the summons and complaint are guilty of complicity in the offenses listed above; and¼Òȯ ¹× °í¹ß¿¡ óÇÑ ÈÇРȸ»ç°¡ À§¿¡ ¿°ÅµÈ ¹üÁË¿¡ ¿¬·çµÈ ÁË°¡ ÀÖ´ÂÁö ¿©ºÎ
- that the United States Government and the Chemical companies which manufactured and supplied Agent Orange must fully compensate the victims of Agent Orange and their families.¿¡ÀÌÀüÆ® ¿À·»Áö¸¦ Á¦Á¶ÇÏ°í °ø±ÞÇÑ ¹Ì±¹ Á¤ºÎ¿Í ÈÇРȸ»çµéÀº ¿¡ÀÌÀüÆ® ¿À·»Áö¿Í ±× °¡Á·µé¿¡°Ô ÃæºÐÇÑ º¸»óÀ» ÇØ¾ß ÇÑ´Ù. The US Government and the Chemical companies must also repair the environment to remove the contamination of Dioxin from the soil and the waters, and especially from the ¡°hot spots¡± around former US military bases.¹Ì±¹ Á¤ºÎ¿Í ÈÇРȸ»çµéÀº ¶ÇÇÑ Åä¾ç°ú ¹°, ƯÈ÷ ÀÌÀüÀÇ ¹Ì±º ±âÁö ÁÖº¯ÀÇ "ºÐÀï Áö¿ª"¿¡¼ ´ÙÀÌ¿Á½Å ¿À¿°À» Á¦°ÅÇϱâ À§ÇØ È¯°æÀ» °³¼±ÇØ¾ß ÇÑ´Ù.
To complete the above task of compensation and repair, the Tribunal recommends that the Agent Orange Commission be established to assess the amount of compensation to be allocated to each victim, family group, and community.À§ÀÇ º¸»ó ¹× ¼ö¸® ÀÛ¾÷À» ¿Ï·áÇϱâ À§ÇØ, ÀçÆǼҴ ¿¡ÀÌÀüÆ® ¿À·»Áö À§¿øȸ¸¦ ¼³¸³ÇÏ¿© °¢ ÇÇÇØÀÚ, °¡Á· ±×·ì ¹× Áö¿ª »çȸ¿¡ ÇÒ´çµÉ º¸»óÀÇ ¾çÀ» Æò°¡ÇÒ °ÍÀ» ±Ç°íÇÑ´Ù.
The Agent Orange Commission will also determine the amount necessary to provide specialized medical facilities and rehabilitation and other therapeutic services to the victims and their families.¿¡ÀÌÀüÆ® ¿À·»Áö À§¿øȸ´Â ¶ÇÇÑ Èñ»ýÀÚµé°ú ±×µéÀÇ °¡Á·µé¿¡°Ô Àü¹®ÈµÈ ÀÇ·á ½Ã¼³°ú ÀçÈ° ±×¸®°í ´Ù¸¥ Ä¡·á ¼ºñ½º¸¦ Á¦°øÇϴµ¥ ÇÊ¿äÇÑ ¾çÀ» °áÁ¤ÇÒ °ÍÀÌ´Ù.
The Agent Orange Commission will also estimate the costs of the necessary studies of contaminated areas and the cost of environmental repair in the future.¶ÇÇÑ AgentOrangeCommissionÀº ¿À¿°µÈ Áö¿ª¿¡ ÇÊ¿äÇÑ ¿¬±¸ ºñ¿ë°ú ÇâÈÄ È¯°æ ¼ö¸® ºñ¿ëÀ» ÃßÁ¤ÇÕ´Ï´Ù.
The Agent Orange Commission will also determine the amount to be paid to the State of Vietnam to indemnify it for monies it has expended to support the victims and repair the environment.¿¡ÀÌÀüÆ® ¿À·»Áö À§¿øȸ´Â ¶ÇÇÑ Èñ»ýÀÚµéÀ» Áö¿øÇÏ°í ȯ°æÀ» °³¼±Çϱâ À§ÇØ »ç¿ëÇÑ µ·¿¡ ´ëÇØ º£Æ®³² Á¤ºÎ¿¡ ¹è»óÇϱâ À§ÇØ ÁöºÒµÉ ±Ý¾×À» °áÁ¤ÇÒ °ÍÀÌ´Ù.
The Tribunal urges the Government of the Socialist Republic of Vietnam to forthwith constitute such Agent Orange Commission of people of eminence in the fields of medicine, science, engineering, law, epidemiology, agriculture, toxicology, ecology, public administration, and representatives of civil society.ÀÌ ÀçÆǼҴ º£Æ®³² »çȸÁÖÀÇ °øȱ¹ Á¤ºÎ°¡ Áï½Ã ÀǾà, °úÇÐ, ¿£Áö´Ï¾î¸µ, ¹ý·ü, ¿ªÇÐ, ³ó¾÷, µ¶¼ºÇÐ, »ýÅÂÇÐ, °ø°ø ÇàÁ¤, ½Ã¹Î »çȸ ´ëÇ¥ µîÀÇ ºÐ¾ß¿¡¼ Ź¿ùÇÑ ¿ä¿ø ¿À·»Áö À§¿øȸ¸¦ ±¸¼ºÇÒ °ÍÀ» Ã˱¸ÇÏ°í ÀÖ´Ù. The amount of $1.52 billion a year being paid by the United States Government to the US Vietnam veteran victims of Agent Orange can be employed as a guide for the calculations performed by the Agent Orange Commission.¿¡ÀÌÀüÆ® ¿À·»Áö À§¿øȸ(AgentOrangeCommission)°¡ ¼öÇàÇÏ´Â °è»êÀÇ ÁöħÀ¸·Î ¹Ì±¹ Á¤ºÎ°¡ ¸Å³â ¹Ì±¹ º£Æ®³² ÂüÀü ¿ë»çµé¿¡°Ô Áö±ÞÇÏ´Â 15¾ï 2000¸¸´Þ·¯¸¦ »ç¿ëÇÒ ¼ö ÀÖ´Ù.
